However, DLE remains commercially unproven at the scale required for major operations, and regulators are not yet treating a DLE commitment as a substitute for rigorous water impact assessment. The technology’s promise is real, but it does not eliminate permit risk in the near term — it reframes the conversation.
Implications for Investment and Supply Chains
For investors, the tightening regulatory environment in the Atacama introduces schedule and capital risk that due diligence models must now explicitly account for. Projects that carry strong water permit positions secured under prior frameworks represent a meaningful competitive advantage over those still in the approval queue.
Battery manufacturers and original equipment manufacturers sourcing lithium for electric vehicle production have their own reasons to monitor Chilean regulatory developments closely. The Atacama remains indispensable to near-term lithium supply, and any sustained permitting slowdown would tighten an already constrained global market.
